Who Is Responsible For Defective Sidewalks In Westchester County, NY?

Well, it depends…

Typically, each city or town within a county will have its own code which dictates who is responsible for maintaining sidewalks in that area.

In Westchester County the responsibility of maintaining sidewalks will usually fall on one of the following:

  • The abutting landowner of the sidewalk in question
  • The town, village or city where the sidewalk is located

Knowing who is responsible for sidewalks in your town can be very important for several reasons.

If you are injured due to a defective sidewalk, you may be entitled to recover compensation from the responsible party in a premises liability lawsuit.

On the other hand, if a defective sidewalk that you are responsible for causes someone to suffer an injury, you may be sued and held responsible for the accident.

Other Considerations

When a person suffers an injury due to a defective or hazardous sidewalk, the injured person is not automatically entitled to compensation.

In most cases, the responsible party must have been given “prior written notice” of the defective or hazardous condition that caused the accident.

Additionally, the responsible party must have had sufficient time to fix the hazardous condition after being given written notice.
